Terms of use
1. Who these terms are between
Between you and the company that operates RS Research, which is not yet named on this page — one of the reasons these terms are still marked as a draft. The registered name and number will appear here before they take effect.
2. The free website check
The check tells you what our research already holds about a business. Where we have assessed a website, it returns that assessment and where it sits among the others we have assessed in that industry.
Where we have not assessed it, the check says so and returns no score. That is not a low rating and it is not a comment on the site — it means nobody has read it. We will not generate a number for a business nobody has looked at, and you should treat any service that does with suspicion.
An assessment is one person's reading of a website against a published method, on the date shown. It is not an audit, and it does not check whether what a site says is true.
3. What is on this site
The figures on these pages come from our research database and are shown with their source and their date. Search volumes are estimates published by others, quoted as estimates. Where we have no comparable figure we say so rather than filling the gap.
The wording, the scoring methods and the reports are ours. You may quote or link to a page with attribution. You may not republish a report, or copy the site's content to build a competing service, without our written permission.
4. What a brief is, and is not
A brief is research and analysis. It sets out what we found, where each finding came from, and how confident we are in it. Where the evidence is thin, it says so instead of filling the page.
It is not advice you should act on without your own judgement. It is not legal, financial, tax or investment advice, and it does not tell you what your business should do. The decision, and the responsibility for it, stay yours. Research narrows a question; it does not guarantee an outcome, and nothing in a brief should be read as a promise that a course of action will succeed.
A brief describes a market at a moment. Markets move, and a finding that was true when it was recorded may not be true when you read it. Each finding carries its date so you can judge that.
5. What we ask of you
Do not use this site to break the law, to send automated traffic beyond ordinary browsing, to attempt to reach parts of it you are not authorised to, or to submit somebody else's details as your own.
6. Availability
We try to keep the site up and we do not promise it always will be. We may change or withdraw any part of it. Where a change affects a client engagement already agreed, the engagement's own terms come first.
7. Liability
Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.
Subject to that, we are not liable for a business decision you take after reading this site or a report, for profits you expected and did not make, or for losses that were not a foreseeable consequence of our work. Where we are liable for a paid engagement, our liability is limited to the fee paid for it.
This is not us disclaiming our work. We stand behind the method and the evidence, and a brief that turns out to rest on a mistake is one we will correct and reissue. What we cannot carry is the commercial risk of a decision that was always yours to make.
8. Governing law
These terms are governed by the law of Malaysia, and its courts have jurisdiction over any dispute arising from them.
